Please read these Terms carefully before using our Platform. These Terms contain important information about your legal rights and obligations, including an arbitration clause and class action waiver in Section 12. By using My GiveBack Hub, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the My GiveBack Hub platform, website, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the Platform.
These Terms apply to all users of the Platform, including consumers who submit service requests, service providers who apply for and maintain provider accounts, and charitable organizations who participate in our giveback program. Additional terms may apply to specific features or services and will be presented to you at the relevant time.
2. Description of Services
My GiveBack Hub operates an online marketplace platform that connects individuals seeking home services ("Consumers") with pre-screened, vetted service professionals ("Service Providers"). As part of each completed service transaction, participating Service Providers independently contribute a percentage of the job value directly to a designated charitable organization ("Giveback Contribution").
My GiveBack Hub is a marketplace platform and connector only. We do not provide home services, employ Service Providers, guarantee the outcome of any service engagement, or act as a financial intermediary for any transaction, including charitable giveback contributions. Our role is to facilitate introductions between Consumers and Service Providers, maintain platform quality and accountability standards, and provide tracking tools that allow Service Providers and charitable organizations to communicate about contribution activity. We are not a party to any service agreement between a Consumer and a Service Provider, nor are we a party to any financial transaction between a Service Provider and a charitable organization.
3. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
4. Consumer Terms
Service Requests
Consumers may submit service requests through the Platform without creating an account. When you submit a request, you agree to provide accurate, complete, and current information. You will receive a secure tracking link via email to monitor the status of your request. You are responsible for ensuring someone with authority is available at the service location at the agreed time.
Matching and Contact
By submitting a service request, you consent to being contacted by My GiveBack Hub and by matched Service Providers via the contact methods you provide, including email, phone, and SMS, as indicated during request submission. Standard message and data rates may apply to SMS communications.
Charity Selection
When submitting a service request, you may designate a charitable organization to receive the Giveback Contribution associated with your completed job. If you do not designate a charity, the contribution will be directed to the Service Provider's affiliated charity. Your designation does not increase the cost of the service to you in any way.
By submitting a request, you acknowledge and agree that My GiveBack Hub does not collect, hold, control, or transmit Giveback Contributions on your behalf or on behalf of any charity. The sole responsibility for making Giveback Contributions rests with the Service Provider. My GiveBack Hub's role is limited to operating the Platform, tracking reported contribution activity for quality and accountability purposes, and taking remedial action against Service Providers who fail to honor their commitments. My GiveBack Hub makes no guarantee that any specific Giveback Contribution will be made and assumes no financial liability for any failure by a Service Provider to donate.
Reviews
Following the completion of a service job, you may submit a review of the Service Provider. Reviews must be truthful, based on your actual experience, and comply with our Community Guidelines. We reserve the right to remove reviews that are fraudulent, defamatory, or in violation of these Terms. Only Consumers with a verified completed job may submit a review.
No Direct Payment Through Platform
Payment for services is made directly between the Consumer and the Service Provider unless otherwise specified. My GiveBack Hub does not process payments between Consumers and Service Providers for individual service jobs. Any payment disputes are between the Consumer and the Service Provider.
No Guarantee of Estimates, Availability, or Final Pricing
Any pricing, estimates, availability, timelines, or service information provided through the Platform, by a Service Provider, or through automated tools are for informational purposes only unless separately agreed in writing between the Consumer and the Service Provider.
My GiveBack Hub does not guarantee that any Service Provider will accept a job, be available at a requested time, honor a particular estimate, complete the service within a specific timeframe, or perform services at any particular price.
Final pricing, scope of work, scheduling, warranties, refunds, cancellations, and service terms are solely between the Consumer and the Service Provider.
SMS and Phone Communications
By providing a phone number, you consent to receive service-related calls and text messages from My GiveBack Hub and matched Service Providers regarding your request, account, service status, estimates, scheduling, job completion, contribution confirmation, and related Platform activity.
Message and data rates may apply. Consent to receive marketing text messages is not required to use the Platform or purchase services.
You may opt out of SMS messages by replying STOP or by contacting us through any reasonable method that clearly communicates your request to stop receiving text messages.
5. Service Provider Terms
Application and Approval
To become a Service Provider on the Platform, you must submit an application, pass our verification process (which may include license verification, insurance confirmation, and background screening), and maintain an active subscription. Approval is at our sole discretion. We reserve the right to reject any application or revoke approval at any time for any reason, including but not limited to failure to maintain required credentials, violation of these Terms, or receipt of consistent poor reviews.
Account Accuracy
You agree to maintain accurate and current information in your service provider account at all times, including valid license numbers, active insurance certificates, correct service area ZIP codes, and current contact information. You must notify us within 5 business days of any material change to your credentials, including license expiration, lapse in insurance coverage, or change in service area.
Subscription, Billing, and Cancellation
Service Provider access to leads, account features, and the Service Provider Portal may require an active paid subscription. Subscription fees are billed on a recurring basis according to the plan selected at enrollment.
By enrolling in a paid subscription, the Service Provider authorizes My GiveBack Hub or its third-party payment processor to charge the payment method on file for recurring subscription fees, applicable taxes, and any other agreed charges.
Unless otherwise stated at the time of enrollment, subscription fees are non-refundable. A Service Provider may cancel future recurring billing according to the cancellation process made available through the Platform or by contacting My GiveBack Hub. Cancellation stops future billing but does not entitle the Service Provider to a refund for fees already charged, except where required by applicable law.
My GiveBack Hub may modify subscription pricing, plan features, service areas, lead access, or provider participation requirements with notice. Continued use of the Platform after changes become effective constitutes acceptance of the updated terms.
Giveback Commitment
By joining the Platform, Service Providers commit to contributing a minimum percentage of each completed job's value to the designated charitable organization, as specified in their service provider application and account settings ("Giveback Percentage"). This commitment is a material condition of participation. Failure to honor Giveback Contributions may result in suspension or termination of your service provider account. The minimum Giveback Percentage is 1% of the completed job value.
Giveback Payment Process
Service Providers are solely responsible for making Giveback Contributions directly to the designated charity following job completion. My GiveBack Hub does not collect, process, hold, or transfer any Giveback Contribution funds. Payments are made directly from the Service Provider to the charity - My GiveBack Hub is never a party to, or intermediary in, any financial transaction between a Service Provider and a charity.
The Platform provides tracking tools to allow Service Providers to record contributions and charitable organizations to confirm receipt. Contributions should be made within 30 days of job completion. My GiveBack Hub monitors reported contribution activity for platform quality and reputation purposes only and does not provide accounting, auditing, tax, or financial advisory services in connection with any Giveback Contribution.
My GiveBack Hub Role - No Financial Intermediary
My GiveBack Hub is a technology platform and marketplace connector. We do not act as a financial intermediary, payment processor, escrow agent, trustee, or guarantor with respect to any Giveback Contribution. We do not receive, hold, disburse, or account for charitable funds on behalf of any party.
Our role in the giveback program is strictly limited to: (a) operating the Platform and its contribution tracking tools; (b) setting minimum participation standards for Service Providers; (c) facilitating communication between Service Providers and charitable organizations regarding contribution status; and (d) taking remedial action (including suspension or removal) against Service Providers who demonstrate a pattern of non-compliance. Nothing in these Terms creates any agency, fiduciary, or trust relationship between My GiveBack Hub and any charitable organization or consumer with respect to charitable funds.
Disclaimer of Liability for Giveback Contributions
My GiveBack Hub expressly disclaims any and all liability arising from a Service Provider's failure to make, delay in making, or underpayment of any Giveback Contribution. By using the Platform, all parties - including Consumers, Service Providers, and Charitable Organizations - acknowledge and agree that:
• My GiveBack Hub is not responsible for ensuring that any individual Giveback Contribution is made, timely, or accurate; • My GiveBack Hub is not liable for any tax consequences, reporting obligations, or financial outcomes related to Giveback Contributions; • All disputes regarding the amount, timing, or receipt of a Giveback Contribution are solely between the Service Provider and the charitable organization; • My GiveBack Hub's tracking and monitoring tools are provided as a convenience and do not constitute a financial audit, guarantee, or verification of actual payment; • Service Providers are solely responsible for compliance with all applicable laws related to charitable giving, including but not limited to tax deductibility rules and charitable solicitation regulations.
Independent Contractor Status
Service Providers are independent contractors, not employees, agents, or partners of My GiveBack Hub. Nothing in these Terms creates any employment, partnership, joint venture, or agency relationship between My GiveBack Hub and any Service Provider. Service Providers are solely responsible for their own taxes, insurance, licenses, and compliance with applicable laws and regulations.
Service Quality
Service Providers agree to conduct themselves professionally in all interactions with Consumers, to perform services in accordance with applicable industry standards, to honor all commitments made to Consumers through the Platform, and to respond to service requests in a timely manner. Consistent failure to maintain service quality standards may result in suspension or termination of your service provider account.
Service Provider Compliance With Laws
Service Providers are solely responsible for determining and maintaining all licenses, permits, registrations, bonds, insurance, tax registrations, professional qualifications, and legal requirements applicable to the services they offer.
Service Providers agree to comply with all applicable federal, state, county, municipal, licensing, consumer protection, advertising, privacy, tax, employment, contractor, insurance, safety, and charitable giving laws.
Service Providers may not represent that My GiveBack Hub has verified, guaranteed, endorsed, supervised, or approved any particular service, price, warranty, license status, insurance coverage, tax treatment, or charitable contribution beyond the limited platform participation standards stated in these Terms.
Consumer Data Use by Service Providers
Service Providers may use Consumer information only to respond to and fulfill the specific service request, provide estimates, schedule appointments, perform agreed services, communicate about the job, process payments, maintain business records, and comply with legal obligations.
Service Providers may not sell Consumer information, share it with unrelated third parties, or use it for unrelated marketing without the Consumer's separate consent.
Service Providers are responsible for protecting Consumer information they receive through the Platform and for complying with all applicable privacy, data security, telemarketing, texting, email marketing, and consumer communication laws.
Charitable Giving, Tax Treatment, and Solicitation
Service Providers are solely responsible for making any Giveback Contribution directly to the applicable charitable organization and for maintaining their own records of such contributions.
My GiveBack Hub does not provide tax, legal, accounting, charitable solicitation, fundraising, or financial advice. My GiveBack Hub does not determine whether any Giveback Contribution is tax deductible, whether a Service Provider may claim a deduction, or whether any specific reporting obligation applies.
Service Providers are solely responsible for determining whether their Giveback Contributions, marketing claims, invoices, receipts, donation records, or customer communications comply with applicable tax, charitable solicitation, consumer protection, advertising, and business laws.
Consumers acknowledge that they are not making a charitable contribution through My GiveBack Hub by requesting a service through the Platform. Unless otherwise stated in writing by the applicable charity, any Giveback Contribution is made by the Service Provider, not by the Consumer or My GiveBack Hub.
6. Charitable Organization Terms
Charitable Organization Responsibilities
Charitable Organizations are solely responsible for maintaining their tax-exempt status, charitable registration status, donation receipt practices, reporting obligations, and compliance with all laws applicable to their organization.
Charitable Organizations agree to provide accurate information about their organization, mission, tax-exempt status, contact information, and contribution confirmation process.
Charitable Organizations acknowledge that My GiveBack Hub does not act as a professional fundraiser, commercial co-venturer, fundraising counsel, escrow agent, trustee, payment processor, or financial intermediary for charitable funds.
Charitable Organizations are responsible for determining whether their participation on the Platform creates any registration, disclosure, reporting, receipting, or compliance obligation for their organization.
My GiveBack Hub may remove, suspend, or limit any Charitable Organization from the Platform at any time if My GiveBack Hub determines, in its sole discretion, that continued participation may create legal, reputational, operational, or consumer trust concerns.
7. Prohibited Conduct
You agree not to use the Platform to:
• Submit false, misleading, or fraudulent service requests or provider applications • Impersonate any person or entity or misrepresent your affiliation with any person or entity • Harass, threaten, or intimidate other users, Service Providers, or My GiveBack Hub staff • Circumvent the Platform by soliciting or accepting payment outside the normal service process in a manner intended to avoid Giveback Contributions • Scrape, crawl, or otherwise extract data from the Platform without our express written consent • Introduce viruses, malware, or other harmful code to the Platform • Attempt to gain unauthorized access to any part of the Platform, other user accounts, or our systems • Use the Platform for any unlawful purpose or in violation of any applicable federal, state, or local law • Post or transmit defamatory, obscene, or fraudulent content, including fake reviews • Interfere with the proper operation of the Platform • Misrepresent the amount, timing, status, or recipient of any Giveback Contribution • Claim that My GiveBack Hub guarantees, collects, processes, verifies, audits, or distributes charitable contributions • Use the Platform to make false, misleading, deceptive, or unsubstantiated charitable, environmental, social impact, pricing, licensing, insurance, endorsement, or service quality claims • Contact Consumers for unrelated marketing or sell, transfer, or misuse Consumer information received through the Platform • Upload false, expired, altered, misleading, or fraudulent licenses, insurance certificates, business records, receipts, contribution confirmations, or verification documents • Use automated tools, bots, scraping tools, or unauthorized scripts to access leads, accounts, listings, platform data, or user information • Interfere with contribution tracking, review systems, provider rankings, lead distribution, platform security, or account controls • Circumvent the Platform in a way that avoids required subscription fees, provider rules, accountability standards, or Giveback Contribution commitments
Violation of these prohibitions may result in immediate suspension or termination of your access to the Platform and may subject you to legal liability.
8. Intellectual Property and Platform Content
Intellectual Property
All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of My GiveBack Hub or its content suppliers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any Platform content without our express written permission.
By submitting content to the Platform (including reviews, provider descriptions, or other user-generated content), you grant My GiveBack Hub a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content in connection with operating and promoting the Platform.
Platform Content and Marketing Materials
My GiveBack Hub may provide Service Providers and Charitable Organizations with approved logos, badges, descriptions, impact language, marketing materials, profile content, and platform-related branding materials.
Users may use approved My GiveBack Hub materials only in the manner authorized by My GiveBack Hub. My GiveBack Hub may revoke permission to use its name, logos, badges, marketing materials, or brand assets at any time.
Service Providers and Charitable Organizations may not create the impression that My GiveBack Hub guarantees their services, endorses all of their business activities, supervises their work, collects charitable funds, or verifies every contribution unless such claim is expressly authorized in writing.
9. Disclaimers
No Guarantee of Service Quality
My GiveBack Hub vets Service Providers prior to approving them on the Platform, but does not guarantee the quality, safety, or legality of services provided. All service engagements are solely between the Consumer and the Service Provider. We are not liable for any act or omission of any Service Provider.
Platform Availability
We strive to maintain Platform availability but do not guarantee that the Platform will be available at all times, without interruption, or free from errors. We may suspend or discontinue the Platform or any feature thereof at any time without notice.
Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MY GIVEBACK HUB DOES NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
No Guarantee of Charitable Contributions
MY GIVEBACK HUB MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE THAT ANY GIVEBACK CONTRIBUTION WILL BE MADE BY ANY SERVICE PROVIDER, THAT ANY CONTRIBUTION WILL BE MADE IN A SPECIFIC AMOUNT OR WITHIN A SPECIFIC TIME, OR THAT ANY CONTRIBUTION WILL QUALIFY FOR ANY TAX BENEFIT. MY GIVEBACK HUB IS NOT A CHARITABLE ORGANIZATION AND DOES NOT SOLICIT, COLLECT, OR DISTRIBUTE CHARITABLE FUNDS. ALL GIVEBACK CONTRIBUTIONS ARE MADE DIRECTLY BETWEEN SERVICE PROVIDERS AND CHARITY PARTNERS, INDEPENDENT OF MY GIVEBACK HUB. THE PLATFORM'S CONTRIBUTION TRACKING FEATURES ARE PROVIDED FOR INFORMATIONAL AND ACCOUNTABILITY PURPOSES ONLY AND DO NOT CONSTITUTE AN AUDIT, VERIFICATION, OR GUARANTEE OF ACTUAL PAYMENT.
No Professional Advice
The Platform may include general information, automated tools, summaries, dashboards, contribution tracking, provider information, charity information, or other content. This content is provided for general informational and operational purposes only.
My GiveBack Hub does not provide legal, tax, accounting, financial, insurance, construction, contractor, charitable solicitation, fundraising, or professional advice. Users are solely responsible for their own business, tax, legal, licensing, insurance, donation, and service decisions.
No Emergency Services
The Platform is not intended for emergency services or urgent safety issues. Consumers should not use the Platform for emergencies, hazardous conditions, active water intrusion, gas leaks, electrical hazards, fire, medical emergencies, or any condition requiring immediate emergency response. For emergencies, call 911 or the appropriate emergency service immediately.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY GIVEBACK HUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL MY GIVEBACK HUB'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MY GIVEBACK HUB IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify, defend, and hold harmless My GiveBack Hub and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way related to your use of the Platform, your violation of these Terms, your violation of any applicable law or regulation, or any service performed or not performed by you as a Service Provider.
Additional Service Provider Indemnification
Service Providers agree to indemnify, defend, and hold harmless My GiveBack Hub and its officers, directors, employees, agents, contractors, successors, and affiliates from and against any claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
• Services performed or not performed by the Service Provider • Any dispute between the Service Provider and a Consumer • Any injury, property damage, loss, defect, warranty issue, pricing dispute, refund dispute, or service quality issue • Any failure to maintain required licenses, permits, insurance, bonds, registrations, or qualifications • Any false, misleading, deceptive, or unlawful advertising or marketing claim • Any failure to make, accurately report, timely complete, or properly document a Giveback Contribution • Any charitable solicitation, tax, accounting, donation receipt, or reporting issue related to the Service Provider's Giveback Contributions • Any misuse, unauthorized disclosure, or improper handling of Consumer information
12. Dispute Resolution
Arbitration Notice and Opt Out
THESE TERMS REQUIRE MOST DISPUTES TO BE RESOLVED BY BINDING ARBITRATION RATHER THAN IN COURT. ARBITRATION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.
A user may opt out of the arbitration agreement by sending written notice to My GiveBack Hub within 30 days after first accepting these Terms. The notice must include the user's full name, email address, mailing address, and a clear statement that the user wishes to opt out of arbitration. The opt-out notice must be sent to: legal@mygivebackhub.org. Opting out of arbitration does not affect any other part of these Terms.
Informal Resolution
Before initiating any formal dispute, you agree to contact us at legal@mygivebackhub.org and attempt to resolve the dispute informally. We will attempt to respond within 30 days. Many concerns can be resolved quickly and to your satisfaction through this process.
Arbitration
If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English, in the State of Arizona. Each party shall bear its own costs of arbitration. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law, you agree to waive the right to participate as a plaintiff or class member in any purported class action, collective action, or representative proceeding.
Exceptions
Nothing in this Section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Subject to the arbitration agreement above, you consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for any matters not subject to arbitration.
14. Termination
My GiveBack Hub reserves the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including but not limited to violations of these Terms, non-payment of subscription fees, or conduct that we reasonably believe is harmful to other users, third parties, or the Platform. Upon termination, your right to use the Platform ceases immediately. Sections 8 through 13 of these Terms survive any termination.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date and, where appropriate, by sending you an email notification. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must discontinue use of the Platform.
16. General Provisions
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and My GiveBack Hub with respect to the Platform. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to do so in the future. These Terms are personal to you and may not be assigned or transferred without our written consent.
Electronic Communications and Consent
By using the Platform, submitting a service request, applying as a Service Provider, applying as a Charitable Organization, creating an account, or providing contact information, you consent to receive electronic communications from My GiveBack Hub. These communications may include account notices, legal notices, service updates, provider communications, charity confirmation notices, payment or subscription notices, security alerts, and other communications related to the Platform. You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
SMS and Phone Communications
By providing a phone number, you consent to receive service-related calls and text messages from My GiveBack Hub and matched Service Providers regarding your request, account, service status, estimates, scheduling, job completion, contribution confirmation, and related Platform activity. Message and data rates may apply. Consent to receive marketing text messages is not required to use the Platform or purchase services. You may opt out of SMS messages by replying STOP or by contacting us through any reasonable method that clearly communicates your request to stop receiving text messages.
Force Majeure
My GiveBack Hub shall not be liable for any delay, failure, interruption, outage, loss, or inability to perform resulting from events beyond its reasonable control, including acts of God, natural disasters, fires, floods, storms, labor disputes, internet or hosting failures, cyber incidents, government actions, war, terrorism, civil unrest, utility failures, payment processor issues, vendor outages, or other events outside our reasonable control.
